What Texas companies building software should know
Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024, applies to businesses operating in Texas or offering products consumed by Texans that process personal data. Businesses meeting the SBA definition of a small business are generally exempt, but must still obtain consent before selling sensitive data. The Attorney General enforces it, with a 30-day cure period and penalties of up to $7,500 per violation.
Texas Responsible Artificial Intelligence Governance Act (HB 149) took effect January 1, 2026. If your software uses AI in ways that affect customers, we'll document how it works so your counsel can assess obligations.
