What Florida companies building software should know
Florida Digital Bill of Rights (effective July 1, 2024) is narrow: it applies to very large companies - over $1 billion in global revenue that also meet additional tests such as running an app store or smart-speaker service. Most Florida small and mid-sized businesses fall outside it.
Florida Information Protection Act (section 501.171) applies much more widely. Businesses must take reasonable measures to protect personal information, notify affected Floridians of a breach within 30 days, and notify the Department of Legal Affairs when 500 or more Floridians are affected. We build access controls, encryption and audit logs with this in mind.
Florida Telephone Solicitation Act (section 501.059) covers automated sales calls and text messages and requires prior express written consent. It matters for any SMS or messaging automation - have counsel review promotional messaging.
